YourParkNow is a technology app. Nothing more, nothing less. We help drivers find a parking space owned by someone else, and we help that person earn money from their unused space. We are not a parking lot. We are not a valet service. We do not watch your car. We do not own the parking spaces. We do not provide security guards or cameras.
When you use YourParkNow, you are doing the same thing you do when you park on a public street: you park your own car, you keep your own keys, you carry your own insurance, and you take care of your own vehicle. If something happens to your car — theft, damage, scratches, anything — you handle it through your own insurance, exactly like when you park on the street.
Read these Terms carefully. By using YourParkNow, you agree to all of them.
1. Acceptance of These Terms
By creating an account, browsing, listing a parking space, booking a parking space, or using the YourParkNow mobile application or website in any way (collectively, the "Platform"), you agree to be legally bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Platform.
These Terms form a binding contract between you and YourParkNow LLC ("YourParkNow," "we," "us"), a Florida limited liability company.
2. What YourParkNow Is — and What It Is Not
2.1 What we ARE:
YourParkNow is a technology platform that connects two types of users:
- Hosts: Owners of parking spaces who want to earn money by letting drivers park there.
- Guests: Drivers who want to find and pay to use a parking space.
Our role is to facilitate the connection, process the payment, and provide a system for ratings and disputes. That is all.
2.2 What we are NOT:
YourParkNow is NOT, and never represents itself as, any of the following:
- A parking lot or parking garage operator.
- A valet parking service.
- A vehicle storage facility.
- A security service, security guard service, or surveillance provider.
- An insurance company.
- A real estate broker, leasing agent, or property manager.
- A custodian, caretaker, or guardian of any vehicle.
- A party to the rental agreement between Host and Guest.
3. The Legal Nature of Your Use — License, Not Bailment
This section is critical. Please read it carefully.
3.1 You receive a License, not a Bailment
When you book a parking space through YourParkNow, what you receive is a LICENSE — a contractual permission to use the space for a defined period. You do NOT enter into a bailment relationship with the Host, with YourParkNow, or with any other party.
A bailment requires that you hand over possession and control of your vehicle to another party (such as a valet who takes your keys). In YourParkNow, this never happens. You:
- Drive your own vehicle to the space.
- Park your own vehicle without assistance from any attendant.
- Keep your own keys at all times.
- Lock your own vehicle.
- Retrieve your own vehicle when you leave.
Because no possession or control of your vehicle is ever transferred to any other party, no bailment is created under Florida law. This is the same legal structure that applies when you park at a street meter, in a non-attended public lot, or in your own driveway.
3.2 Consequences of License vs. Bailment
Because the relationship is a License, the following is true:
- No party (not YourParkNow, not the Host, not anyone) takes on a duty to safeguard your vehicle.
- No party is responsible for theft, vandalism, damage, scratches, dents, weather damage, or any other harm to your vehicle.
- No party is responsible for items left inside your vehicle.
- Your own automobile insurance is the only source of protection for your vehicle.
4. Disclaimer of Liability — Read Carefully
4.1 What we are not responsible for
YourParkNow expressly disclaims responsibility and liability for the following, to the maximum extent permitted by law:
- Theft of your vehicle, in whole or in part (wheels, mirrors, catalytic converter, anything).
- Theft of items left inside or on your vehicle (purses, electronics, documents, packages).
- Damage from collisions, hit-and-runs, or any third party action.
- Damage from vandalism, graffiti, scratches, dents, or keying.
- Damage from weather events, falling objects, trees, branches, fire, flooding, or other natural causes.
- Damage from animals or pests.
- Towing of your vehicle by the Host, an HOA, law enforcement, or any third party for any reason.
- Parking tickets, citations, fines, or violations from city, county, or state authorities.
- Disputes between Hosts and Guests.
- Personal injury occurring at, near, or in connection with the parking space.
- Acts of other users, neighbors, passersby, or third parties.
- Inaccurate listings, photos, descriptions, or directions provided by Hosts.
- Unavailability of the parking space when you arrive.
- Failure of you or any other user to receive an SMS, email, push notification, or other communication on time.
- Mechanical issues with your vehicle that occur before, during, or after parking.
- Force majeure events (severe weather, government action, pandemic, civil unrest, etc.).
4.2 Comparison to public street parking
Think of it this way: when you park on a public street in Miami, on a parkmeter spot, in a city garage that you operate yourself, or on any other public parking area:
- If your car is stolen, the city is not responsible.
- If your car is hit, the city is not responsible.
- If your wheels are stolen, the city is not responsible.
- If you receive a parking ticket, the city is not responsible — you are.
- If you forget to feed the meter and get towed, the city is not responsible — you are.
YourParkNow operates under the exact same principle. The only differences are: (a) the parking space is on private property instead of public, and (b) the property owner is being compensated for letting you use the space. The legal responsibility for your vehicle, your insurance, and your conduct remains entirely yours.
5. Your Responsibilities as a Guest
5.1 Verify the space before you book
YourParkNow strongly recommends — and you agree — that you physically arrive at the parking location and confirm the space is empty, accessible, and suitable BEFORE making your reservation. Do not make reservations from a distance. Drive to the location, see the space, then book it.
5.2 Maintain valid insurance
You represent and warrant that your vehicle has current, valid automobile insurance that meets or exceeds the minimum requirements of the state where the vehicle is registered.
5.3 Use the space only for parking
You will use the space only to park a registered, operational vehicle of standard size and standard use. You will NOT:
- Sleep, live, or stay overnight in the vehicle while parked.
- Conduct any commercial activity (food sales, rideshare staging, deliveries, etc.).
- Perform vehicle maintenance, repairs, oil changes, washing, or detailing.
- Park trailers, RVs, boats, or commercial vehicles unless the listing allows them.
- Block driveways, walkways, mailboxes, fire hydrants, or access to other parking spaces.
- Leave the vehicle in a state of disrepair.
- Store hazardous materials, weapons, illegal substances, or stolen goods in the vehicle.
- Allow another driver to use your reservation.
- Resell, sublet, transfer, or assign your reservation to a third party.
5.4 Respect the time window
If you stay past your reservation end time without an approved extension, the Host has the legal right to have your vehicle towed at your sole expense. YourParkNow may also charge:
- $25 plus $10 per hour for unauthorized extended stay.
- $100 for blocking another parking space.
- Up to $500 for causing the Host to receive an HOA fine, lease violation, or municipal citation.
- Reasonable cleanup or repair costs for damage to the space.
6. Your Responsibilities as a Host
6.1 You have the legal right to list the space
You represent and warrant that you have full legal authority to list this parking space:
- The owner of the property, OR
- A tenant whose lease includes use of this parking space AND you have written permission from the landlord, OR
- A condominium unit owner whose deeded parking space is not restricted from rental by your HOA/COA, OR
- Otherwise legally authorized.
6.2 HOA, lease, and zoning compliance
It is YOUR sole responsibility to verify that listing your space does not violate any HOA, condominium, lease, or municipal rule. YourParkNow does not verify this and is not responsible if you violate a rule.
6.3 Accurate listings, honor reservations, and Host conduct
All photos, descriptions, dimensions must be accurate. You must honor confirmed reservations. You will not damage, tamper with, vandalize, or interfere with any Guest vehicle. Damage caused by a Host's intentional or grossly negligent conduct is the Host's sole responsibility.
7. Service Fees and Payments
The total amount paid by the Guest includes: (a) the parking rate set by the Host, (b) a YourParkNow service fee of 15% of the parking rate, and (c) any applicable taxes. All payments are processed by Stripe, Inc. YourParkNow does not store full payment card details.
8. Cancellations and Refunds
See our Refund and Cancellation Policy for full details. Summary:
- Guest cancellation 24+ hours before start: full refund minus $1 processing fee.
- Guest cancellation 2-24 hours before start: 50% refund.
- Guest cancellation less than 2 hours before or no-show: no refund.
- Host cancellation: full refund to Guest, including service fees.
9. Notifications and Communications
YourParkNow uses email, SMS, and push notifications. You acknowledge that delivery is dependent on your phone carrier, internet service provider, and device settings, and is NEVER 100% guaranteed. You are solely responsible for monitoring your reservation status.
10. Account Eligibility and Suspension
You must be at least 18 years old. YourParkNow may suspend or terminate your account for violations, fraudulent activity, repeated complaints, abusive behavior, or at our sole discretion.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOURPARKNOW'S TOTAL CUMULATIVE LIABILITY TO ANY USER SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY THE USER TO YOURPARKNOW IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100 USD).
IN NO EVENT SHALL YOURPARKNOW BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
12. Indemnification by User
You agree to indemnify, defend, and hold harmless YourParkNow LLC from any claims arising out of your use of the Platform, your violation of these Terms, or any dispute between you and another user.
13. Dispute Resolution and Mandatory Arbitration
Any dispute shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under Consumer Arbitration Rules, in Miami-Dade County, Florida, in English or Spanish.
CLASS ACTION WAIVER: You agree that any arbitration shall be conducted on an individual basis only. You waive any right to bring or participate in a class action.
14. Governing Law
These Terms are governed by the laws of the State of Florida. Exclusive venue is in Miami-Dade County, Florida.
15. Modifications to These Terms
YourParkNow may update these Terms at any time. Material changes will be communicated at least 14 days before taking effect.
16. General Provisions
If any provision is unenforceable, the rest remain in effect. Failure to enforce is not a waiver. You may not assign these Terms. Force majeure events excuse non-performance.

1. Aceptación de Estos Términos
Al crear una cuenta, navegar, listar un espacio de parqueo, reservar un espacio de parqueo, o usar la aplicación móvil o sitio web de YourParkNow de cualquier forma (colectivamente, la "Plataforma"), usted acepta quedar legalmente obligado por estos Términos y Condiciones ("Términos"). 2. Qué Es YourParkNow — y Qué No Es

YourParkNow es una plataforma tecnológica que conecta a dos tipos de usuarios:
- Anfitriones: Dueños de espacios de parqueo que quieren ganar dinero permitiendo que conductores parqueen ahí.
- Huéspedes: Conductores que quieren encontrar y pagar por usar un espacio de parqueo.
Nuestro rol es facilitar la conexión, procesar el pago, y proveer un sistema de calificaciones y disputas. Eso es todo.
2.2 Lo que NO somos:
YourParkNow NO ES, y nunca se presenta como, ninguno de los siguientes:
- Un operador de lote o garaje de parqueo.
- Un servicio de valet parking.
- Una instalación de almacenamiento de vehículos.
- Un servicio de seguridad, guardias o vigilancia.
- Una compañía de seguros.
- Un corredor de bienes raíces, agente de arrendamiento o administrador de propiedades.
- Un custodio, cuidador o guardián de ningún vehículo.
- Una parte en el acuerdo de renta entre Anfitrión y Huésped.
3. La Naturaleza Legal de Su Uso — Licencia, No Bailment
Esta sección es crítica. Por favor léala con cuidado.
3.1 Usted recibe una Licencia, no un Bailment
Cuando reserva un espacio de parqueo a través de YourParkNow, lo que recibe es una LICENCIA — un permiso contractual para usar el espacio por un período definido. Usted NO entra en una relación de "bailment" con el Anfitrión, con YourParkNow, ni con ninguna otra parte.
Un bailment requiere que usted entregue posesión y control de su vehículo a otra parte (como un valet que toma sus llaves). En YourParkNow esto nunca ocurre. Usted:
- Maneja su propio vehículo hasta el espacio.
- Parquea su propio vehículo sin asistencia de ningún empleado.
- Se queda con sus llaves en todo momento.
- Cierra su propio vehículo.
- Recoge su propio vehículo cuando se va.
Como nunca hay transferencia de posesión o control de su vehículo a otra parte, no se crea un bailment bajo la ley de Florida.
4. Exclusión de Responsabilidad — Lea con Cuidado
4.1 Por lo que no somos responsables
YourParkNow expresamente excluye responsabilidad por lo siguiente:
- Robo de su vehículo, completo o parcial.
- Robo de artículos dejados dentro o encima de su vehículo.
- Daño por colisiones, choques y fugas, o cualquier acción de terceros.
- Daño por vandalismo, graffiti, rayones, abolladuras.
- Daño por clima, objetos que caen, árboles, fuego, inundación.
- Remolque de su vehículo por cualquier razón.
- Multas de parqueo de cualquier autoridad.
- Disputas entre Anfitriones y Huéspedes.
- Lesiones personales.
- Actos de otros usuarios, vecinos, transeúntes, o terceros.
- Listados inexactos proporcionados por Anfitriones.
- Falla para recibir notificaciones a tiempo.
- Eventos de fuerza mayor.
4.2 Comparación con parqueo en la calle pública
Piénselo así: cuando usted parquea en una calle pública en Miami:
- Si le roban el carro, la ciudad no es responsable.
- Si le chocan el carro, la ciudad no es responsable.
- Si recibe una multa de parqueo, usted lo es.
- Si se le olvida pagar el parquímetro y le remolcan, usted lo es.
YourParkNow opera bajo exactamente el mismo principio.
5. Sus Responsabilidades como Huésped
5.1 Verifique el espacio antes de reservar
YourParkNow recomienda fuertemente que físicamente llegue a la ubicación del parqueo y confirme que el espacio está vacío, accesible, y adecuado ANTES de hacer su reservación. No haga reservaciones a distancia.
5.2 Mantenga seguro válido
Su vehículo debe tener seguro automotriz vigente y válido.
5.3 Use el espacio solo para parquear
Usted NO:
- Dormirá ni vivirá en el vehículo.
- Realizará actividad comercial.
- Realizará mantenimiento o reparaciones en el espacio.
- Parqueará trailers, RVs, botes sin autorización.
- Bloqueará driveways, banquetas, hidrantes.
- Almacenará materiales peligrosos o ilegales.
- Permitirá que otro conductor use su reservación.
- Revenderá o transferirá su reservación.
5.4 Respete la ventana de tiempo
Si se queda más allá de la hora de fin, el Anfitrión puede mandar a remolcar su vehículo. YourParkNow puede cobrar:
- $25 más $10 por hora por estadía extendida.
- $100 por bloquear otro espacio.
- Hasta $500 por causar multa de HOA al Anfitrión.
6. Sus Responsabilidades como Anfitrión
Usted declara que tiene autoridad legal para listar el espacio (dueño, inquilino autorizado, o dueño de condominio sin restricción HOA). Es SU responsabilidad verificar que listar el espacio no viole HOA, contrato, ni regla municipal.
Las fotos y descripciones deben ser precisas. Debe honrar las reservaciones confirmadas. No dañará ni interferirá con vehículos de Huéspedes.
7. Tarifas de Servicio y Pagos
El monto total pagado por el Huésped incluye: (a) la tarifa del Anfitrión, (b) tarifa de servicio de YourParkNow del 15%, (c) impuestos aplicables. Todos los pagos son procesados por Stripe, Inc.
8. Cancelaciones y Reembolsos
Ver nuestra Política de Reembolso. Resumen:
- Cancelación 24+ horas antes: reembolso completo menos $1.
- Cancelación 2-24 horas antes: reembolso del 50%.
- Menos de 2 horas o no se presenta: sin reembolso.
- Cancelación del Anfitrión: reembolso completo.
9. Notificaciones y Comunicaciones
La entrega de notificaciones NUNCA está garantizada al 100%. Usted es responsable de monitorear su reservación.
10. Elegibilidad y Suspensión
Debe tener al menos 18 años. YourParkNow puede suspender o terminar cuentas por violaciones, fraude, o a discreción exclusiva.
11. Limitación de Responsabilidad
LA RESPONSABILIDAD TOTAL DE YOURPARKNOW NO EXCEDERÁ EL MAYOR DE: (A) TARIFAS PAGADAS EN LOS 12 MESES PREVIOS, O (B) CIEN DÓLARES ($100 USD).
12. Indemnización por el Usuario
Usted indemniza a YourParkNow de cualquier reclamo derivado de su uso de la Plataforma o disputas con otros usuarios.
13. Resolución de Disputas y Arbitraje Obligatorio
Cualquier disputa se resolverá por arbitraje vinculante administrado por la AAA en Miami-Dade, Florida, en inglés o español.
RENUNCIA A ACCIÓN DE CLASE: Solo procedimientos individuales, no colectivos.
14. Ley Aplicable

YourParkNow puede actualizar estos Términos. Cambios materiales notificados 14 días antes.
16. Disposiciones Generales
Si alguna disposición es inejecutable, las demás siguen vigentes. Fuerza mayor excusa incumplimiento.
